 Asalam U Alikum! This topic is about family cases and their kinds. In Pakistan family cases are in very large numbers and almost about more than 200 cases are filed daily in Lahore civil courts only. 


FAMILY CASES AND THEIR KINDS  

The base of family cases is marriage. All the cause of actions of family cases raise after the marriage between two parties. The procedure of family cases is almost very same as the civil cases. The main difference between family cases is cited above and the both type of cases have cause of action. As criminal cases no offence involved in these cases. The kinds of family cases are as under:-


  1. Suit for dissolution of Marriage: This specific case can be filled by the wife only to dissolve the marriage on basics of Khula . Khula considered as first Talaq and both of parties can reunite after Khula.
  2. Suit for restoration of conjugal rights: This specific suit can be filled by the husband only. The cause of action of this suit is when the wife left the house of husband without any reason. This suit can also be filled as counter suit of suit for maintenance.This  case shows the bonafide of the husband as he wanted to get his life running with his wife.
  3. Suit for maintenance and recovery of dower or any other articles and recover of money: This suit can only be filled by the women and the children(not attended the age of majority). This suit can be filled by the woman who is married and divorced. In this case court fixed a specific amount for payment of maintenance for all(wife and the children) and the payment will be bases of  every month.In almost all cases court will fix the amount of monthly from the date of institution of the case. In this case the dowry articles or any expenses on delivery of any other unwanted circumstances can also be provided. This case can be divided in 2 or more parts and can be filed all at once with all the cause of action as mentioned in title.
  4. Suit for jactitation of marriage:  This suit is a rare type of case. This can be filed by both man or woman. This is a special case as in a case when a fake marriage certificate is issued than it can be suspended in this case by the family Judge.

ASALAM U ALIKUM. Today topic is about the civil suits and their kinds in Pakistan. First of all what is a civil suit. A civil suit is a suit in which no offence/criminal proceedings involved. This suit is presented before the Senior Civil Judge and the same marked the suit in court of any civil judge with competent authority.  The Main Difference between civil and criminal cases: The main difference between civil and criminal cases is that the criminal case starts with any offence, further forwarded to FIR and trial and punishments etc. But the civil suit starts with cause of action. This action can be of any party (private man , company , government authority etc).
