CIVIL SUITS AND THEIR KINDS

ASALAM U ALIKUM. Today topic is about the civil suits and their kinds in Pakistan. First of all what is a civil suit. A civil suit is a suit in which no offence/criminal proceedings involved. This suit is presented before the Senior Civil Judge and the same marked the suit in court of any civil judge with competent authority. 

The Main Difference between civil and criminal cases:

The main difference between civil and criminal cases is that the criminal case starts with any offence, further forwarded to FIR and trial and punishments etc. But the civil suit starts with cause of action. This action can be of any party (private man , company , government authority etc). And in many cases a civil case can be converted in a criminal case and a criminal case can be converted in civil, because you can more than one remedy at a time. For example in a case a person is not returning your money, such person can be dealt in both of the platforms. The civil nature cases are time consuming but the criminal cases can be decided in less time.

The kinds of Civil Cases:

There are many kinds of civil cases, kinds and short preview is as under:

  1. Suit for declaration :- the cause of action of this suit arise when their is a dispute of your legal and necessary right. For example (Right of legal heirs, right of correction in CNIC)
  2. Suit for specific performance :-  the suit is instituted when someone manly a person denies to perform the duty on its part. For example you signed an agreement that after payment of all the money the second person will give you the possession of the property. In this case if you pay all the money and second party is not giving you the possession this is the right option to deal with the same.
  3. Suit for right of Pre-Emption:-  This suit is filed when you are interested in the property of your neighbor and the same is not willing to pay intention to your interest.
  4. Suit for permanent injunction:-  When you want someone to do an act or someone to stop from an act then this suit is instituted an extra application for grant of stay will be also annexed with the plaint under Order 39 Rule 1,2. For example when authorities of wapda wants to disconnect your electricity connection, court will order to not disconnect the same. 
  5. Suit for recovery of money:-  When someone is not returning your money this suit will be executed.
  6. Suit for rendition of accounts:- When two person are doing the business and dispute arise related to any query of money than this suit can be filed.
  7.  Suit for Compensation:-   This specific suit can be filed in the court of Civil Judge, sessions judge, the main cause of action for this suit is when your self-respect and mental condition is damaged because of word or act of a person.

In Pakistan family cases are in very large numbers and almost about more than 200 cases are filed daily in Lahore civil courts only.  FAMILY CASES AND THEIR KINDS    The base of family cases is marriage. All the cause of actions of family cases raise after the marriage between two parties. The procedure of family cases is almost very same as the civil cases.
